These SMS Terms govern the provision, receipt, and delivery of text messages, WhatsApp messages, and other mobile messages by or on behalf of Bravest Studios LLC (“Bravest,” “we,” “us,” or “our”). By enrolling in, subscribing to, or otherwise consenting to receive messages from Bravest, you agree to these SMS Terms, Bravest’s Terms of Service, and Bravest’s Privacy Policy, each of which is incorporated by reference. We may modify, suspend, or cancel any messaging program, or any feature of any messaging program, at any time, with or without notice, except where prohibited by applicable law.

If there is a conflict between these SMS Terms and Bravest’s Terms of Service or Privacy Policy regarding the operation of Bravest’s text message, WhatsApp, or other mobile messaging programs, these SMS Terms will control solely with respect to those messaging program terms. Bravest’s Privacy Policy will continue to govern how Bravest collects, uses, discloses, retains, and protects personal information.

Disputes. By enrolling in, subscribing to, or otherwise consenting to receive text messages, WhatsApp messages, or other mobile messages from Bravest, you agree to these SMS Terms, Bravest’s Terms of Service, and Bravest’s Privacy Policy, each of which is incorporated by reference. Any claim or dispute arising out of or relating to these SMS Terms, any Bravest messaging program, or any message sent by or on behalf of Bravest shall be resolved in accordance with the dispute resolution, arbitration, class action waiver, governing law, and judicial forum provisions set forth in Bravest’s Terms of Service. 

E-SIGN Disclosure and Consent. By consenting to receive text messages from Bravest, you consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of an electronic record by contacting us at orders@braveststudios.com with “Revoke Electronic Consent” in the subject line. To view and retain a copy of this disclosure or information regarding your enrollment, you will need a device with internet access and either a printer or storage space on that device.

Consent to Receive Text Messages. You may consent to receive text messages from Bravest by providing your phone number at checkout, creating an account, signing up for SMS alerts, opting into marketing messages, communicating with us, or otherwise providing consent through the Site or any Bravest-operated platform. By providing consent, you authorize Bravest and its service providers to send text messages to the phone number associated with your consent using automated or non-automated technology. 

Consent to receive marketing text messages is not a condition of purchase. Your consent to receive marketing text messages is separate from any consent you provide to receive transactional or service-related messages. You may opt out of marketing text messages as described below, but Bravest may still send non-marketing transactional or service-related messages where permitted by applicable law, including messages relating to orders, shipping, delivery, customer service, account activity, security, or your requests.

By providing your mobile number and consenting to receive messages from Bravest, you authorize Bravest to send text messages to that number, including where permitted by applicable law if the number is listed on a federal, state, provincial, or other “Do Not Call” list. Messages may include product launches, limited releases, promotions, markdowns, collaboration announcements, back-in-stock alerts, cart reminders, order updates, shipping updates, customer service messages, and other transactional or marketing communications.

You agree to provide a valid mobile number. If you obtain a new mobile number or stop using the number you provided, you must opt in again using your new number and promptly notify Bravest that the prior number is no longer valid.

WhatsApp Messages. If Bravest makes WhatsApp messaging available and you provide your phone number and consent to receive messages from Bravest through WhatsApp, you authorize Bravest and its service providers to send you messages through WhatsApp, including transactional messages, order updates, shipping or delivery updates, customer service communications, product release information, marketing or promotional messages, back-in-stock alerts, drop reminders, and abandoned-cart reminders. Consent to receive WhatsApp marketing messages is not a condition of purchase. Message frequency may vary. You may opt out of WhatsApp messages by replying STOP to any WhatsApp message from Bravest or by contacting us at orders@braveststudios.com. Your use of WhatsApp is also subject to WhatsApp’s own terms, policies, and privacy practices, and Bravest is not responsible for WhatsApp’s platform, delivery, functionality, or data practices.

Eligibility.  By consenting to receive text messages from Bravest, you represent that you are at least eighteen (18) years old, reside in the United States, and are the subscriber or customary user of the phone number provided. You further represent that you are authorized to consent to receive recurring automated and non-automated marketing and transactional text messages at that number. If you change, forfeit, deactivate, transfer, or stop using the phone number you provided to Bravest, you agree to notify Bravest promptly. Failure to do so may result in messages being sent to another person and constitutes a material breach of these SMS Terms.

Message and Data Rates. Bravest does not charge you for text messages, but message and data rates may apply depending on your wireless plan and carrier.

Message Frequency. Message frequency may vary depending on your interactions with Bravest, including your account activity, purchases, order status, product-release signups, abandoned-cart activity, and marketing preferences.

Carriers; Delivery. Text messages may not be available through all carriers or compatible with all mobile devices. Bravest and the participating carriers are not liable for delayed, failed, incomplete, or undelivered messages.

Opt-Out and Help. To stop receiving text messages from a specific Bravest SMS program or phone number, reply STOP to any text message from that number. After you send STOP, we may send one confirmation message confirming your opt-out. To receive help, reply HELP to any Bravest text message or contact us at orders@braveststudios.com. If you have consented to receive messages from multiple Bravest numbers or programs, you may need to opt out separately from each number or program. We may change any short code, telephone number, WhatsApp account, or other sending method used to operate our messaging programs at any time. You acknowledge that any STOP, HELP, or other request sent to a number, short code, or account that has been changed may not be received, and Bravest will not be responsible for failing to honor requests sent to an inactive or changed number, short code, or account.

Disclaimer; Limitation of Liability. To the fullest extent permitted by applicable law, Bravest does not guarantee that any message will be delivered, delivered on time, error-free, secure, or available at all times. Bravest is not responsible for failed, delayed, incomplete, misdirected, or undelivered messages, errors in message content, carrier issues, platform issues, device issues, network issues, or any action you take or do not take in reliance on any message. To the fullest extent permitted by applicable law, Bravest shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages arising out of or relating to any messaging program.

Messaging Service Provider. Bravest may use third-party service providers, including Postscript, to help operate, administer, deliver, and support its text message, WhatsApp, and other mobile messaging programs. These providers may process information related to your participation in Bravest’s messaging programs, including your phone number, consent records, opt-in and opt-out records, message content, delivery status, interaction data, and related communications information, solely as described in Bravest’s Privacy Policy and as necessary to provide messaging services on Bravest’s behalf.

Vendor Messaging Terms; Order of Precedence. Bravest may use third-party messaging service providers, including Postscript, to operate, administer, deliver, and support its text message, WhatsApp, and other mobile messaging programs. If you enroll in a Bravest messaging program through a pop-up, landing page, checkout flow, sign-up form, or other consent mechanism provided or supported by a third-party messaging service provider, additional or supplemental messaging terms, disclosures, or consent language may be presented to you at the point of sign-up, including dynamic terms that may be updated from time to time by the applicable provider. Those provider terms, disclosures, and consent records are incorporated into these SMS Terms by reference solely to the extent they apply to your enrollment in, consent to, or participation in the applicable Bravest messaging program.

If there is a conflict between these SMS Terms and any provider terms or disclosures, these SMS Terms will control with respect to Bravest’s rights, obligations, limitations of liability, dispute resolution provisions, privacy disclosures, and relationship with you, except to the extent the provider terms include legally required, carrier-required, platform-required, or state-specific terms applicable to the operation of the messaging program, in which case those required terms will control solely to the extent of the conflict. Nothing in any provider terms limits Bravest’s rights under these SMS Terms, Bravest’s Terms of Service, or Bravest’s Privacy Policy, unless expressly required by applicable law.

Privacy. Bravest’s collection, use, disclosure, retention, and protection of personal information in connection with its text message, WhatsApp, and other mobile messaging programs is described in Bravest’s Privacy Policy. This may include your phone number, consent records, opt-in and opt-out records, message content, delivery status, interaction data, device information, account activity, purchase activity, cart activity, product-release signups, marketing preferences, and related communications information.

Changes to SMS Terms. We may modify these SMS Terms at any time by posting updated terms on the Site or otherwise providing notice. Your continued enrollment in Bravest text messages after any update constitutes your acceptance of the updated SMS Terms.
